§ 38-61. Disorderly conduct.

  • (a)

    Scope of violation. Any person who shall use loud, boisterous or obscene language or who shall fight, quarrel or make any unnecessary noise or do any other thing or act within the corporate city limits calculated to disturb the peace, quiet and good order of the city or of any person within the city limits shall be guilty of the offense of disorderly conduct.

    (b)

    Defense to charge. It shall be a full defense to any charge under this section that the offense charged was committed in the reasonable defense of person, family, habitation or property against unprovoked or unlawful attack, assault or trespass; but for a mutual consent to fight, both persons shall be guilty of the offense.

    (c)

    Fine for disorderly fighting. The fine for disorderly fighting is $200.00 for the first offense.
